These Terms of Service ("Terms") govern your access to and use of kling-4.ai, including our website, AI video generation workspace, account features, APIs, credits, subscriptions, and related services (collectively, the "Service").
kling-4.ai is an independent platform for creating AI video with the Kling model family and related generation providers. We are not affiliated with, sponsored by, or endorsed by Kuaishou Technology or the official Kling AI product.
By accessing or using the Service, you agree to these Terms. If you use the Service on behalf of a company or other organization, you confirm that you have authority to bind that organization.
You must be at least 13 years old, or the minimum age required in your country, to use the Service. If you are under the age of majority, you may use the Service only with permission from a parent or legal guardian.

The Service lets you submit prompts, images, reference materials, and other inputs ("Input") to generate videos, previews, metadata, and related content ("Output").

You retain any rights you have in your Input. As between you and kling-4.ai, and to the extent permitted by applicable law, you may use your Output for lawful purposes subject to these Terms, your plan limits, and any checkout terms presented to you.
You grant kling-4.ai a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, reproduce, display, and modify your Input and Output as needed to:
We do not claim ownership of your Input or Output. We retain all rights in the Service itself, including our website, interface, branding, documentation, code, design, workflows, prompts, templates, and technology.
Commercial use is available only where your selected plan, checkout page, or written agreement expressly allows it. Free generations are provided for personal evaluation unless we state otherwise.
You are responsible for confirming that your Input and Output can be used in your intended context, including advertising, client work, e-commerce, social media, music videos, film, television, games, and other commercial settings.
You may not use the Service to create, upload, share, or distribute content or activity that:
We may review, block, remove, or restrict content and accounts when we believe these Terms or applicable laws may have been violated.
The Service may rely on third-party providers for AI generation, hosting, storage, payments, email, authentication, analytics, abuse prevention, and customer support. Your use of those components may be subject to third-party terms and policies.
We may route your Input and related metadata to generation providers so they can produce Output. We are not responsible for third-party platforms, model availability, provider outages, or changes made by those providers.
Some features may require credits, a paid subscription, or a one-time purchase. Prices, credit amounts, renewal terms, plan limits, taxes, and supported payment methods are shown at checkout or in the product interface.

If payment fails, is disputed, appears fraudulent, or violates payment processor rules, we may suspend paid features, cancel credits, or terminate access.
If we provide API access, you are responsible for keeping API keys confidential and for all requests made with your keys. You may not share keys publicly, use the API to bypass product limits, or present the API as your own model service without permission.
We may set or change API rate limits, model availability, credit costs, request size limits, retention settings, and safety controls.
We may, but are not obligated to, monitor content, prompts, accounts, API usage, payment activity, and abuse signals. We may remove content, limit generations, withhold Output, suspend accounts, revoke credits, or report activity if we believe it is necessary to protect users, third parties, the Service, or the public.
Our Privacy Policy explains how we collect, use, share, and protect personal information. By using the Service, you acknowledge that we process information as described in that policy.
We aim to keep the Service reliable, but we do not guarantee that it will always be available, error-free, secure, or uninterrupted. AI models, generation quality, processing time, output formats, free quotas, and pricing may change over time.
We may update, suspend, discontinue, or restrict any part of the Service at any time, including features that are experimental, beta, free, or dependent on third-party providers.
The Service is provided "as is" and "as available." To the maximum extent permitted by law, kling-4.ai disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and uninterrupted operation.
We do not provide legal, intellectual property, advertising, medical, financial, or professional advice. You should obtain appropriate professional review before using Output in high-risk or regulated contexts.
To the maximum extent permitted by law, kling-4.ai and its owners, operators, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, business interruption, reputational harm, or the cost of substitute services.
To the maximum extent permitted by law, our total liability for any claim related to the Service will not exceed the greater of: (a) the amount you paid to kling-4.ai for the Service in the three months before the claim arose, or (b) USD $100.
Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.
You agree to defend, indemnify, and hold harmless kling-4.ai from and against claims, damages, losses, liabilities, costs, and expenses arising from your Input, Output, use of the Service, violation of these Terms, violation of law, or violation of third-party rights.
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms, create risk for the Service or others, fail to pay, or use the Service in a way that may expose us or third parties to liability.
After termination, some sections of these Terms will continue to apply, including ownership, licenses needed for operation and enforcement, payment obligations, disclaimers, limitation of liability, indemnity, and dispute-related provisions.
These Terms are governed by applicable law without regard to conflict-of-law rules, except where consumer protection laws in your jurisdiction require otherwise. If a dispute arises, please contact us first so we can try to resolve it informally.
We may update these Terms from time to time. When we make material changes, we will update the date on this page and may provide additional notice where appropriate. Your continued use of the Service after changes become effective means you accept the updated Terms.
