Terms for using the independently operated kling-4.ai AI video service.

These Terms of Service ("Terms") govern your access to and use of kling-4.ai, including its website, AI video generation workspace, guest and account features, credits, billing features, APIs, emails, and related services (collectively, the "Service").
kling-4.ai is an independently operated online service. It is not affiliated with, sponsored by, or endorsed by Kuaishou Technology or the official Kling AI product.
By using the Service, creating an account, or completing a purchase, you agree to these Terms and our Privacy Policy. If you use the Service for an organization, you represent that you have authority to bind that organization. If you do not agree, do not use the Service.
You must be at least 18 years old and legally capable of entering into a binding agreement to use the Service.

You may not sell, rent, share, or transfer an account or use coordinated accounts to obtain benefits beyond those intended for one customer.
The Service enables users to submit text, images, videos, and generation settings to create AI-generated video and related output. The Service currently supports models including Kling 2.6 and Kling 3.0 Omni. Available models, parameters, prices, generation times, and output formats may change as providers update their services.
The Service relies on third-party AI generation and infrastructure providers. Their availability, safety rules, technical limits, and model behavior may affect a request. References to a model name identify the underlying model and do not imply that kling-4.ai owns that model or is its official operator.
Kling and other third-party model names and trademarks belong to their respective owners. Their appearance in our domain, articles, or interface does not imply a partnership or official authorization. Editorial coverage of a future model or release date is not an offer of access to that model. Check the generation workspace for the models actually available before purchasing credits; a subscription does not guarantee access to future models.
Content that you submit to the Service, including prompts, images, videos, audio, likenesses, trademarks, and other reference materials, is your "Input." Videos, previews, images, metadata, and other material generated in response are "Output."
You retain any rights you have in your Input. You represent that you own or have all permissions necessary to submit and use your Input, including any copyright, trademark, privacy, publicity, voice, and likeness rights.
As between you and kling-4.ai, and to the extent permitted by law and the applicable model terms, you may use your Output for lawful purposes permitted by the plan or product you selected. AI Output may not qualify for copyright protection in every jurisdiction, may resemble material generated for others, and may contain errors or third-party material. You are responsible for reviewing Output before publishing, distributing, selling, or relying on it.
You grant us a limited, non-exclusive license to host, process, transmit, reproduce, and technically modify Input and Output only as reasonably needed to provide the Service, secure it, investigate reports, provide support, and comply with law. We do not claim ownership of your Input or Output.
We retain all rights in the Service itself, including its software, interface, branding, documentation, workflows, and original materials.
You may use the Service only for lawful purposes. You may not use or attempt to use it to create, upload, process, publish, or distribute:

We may use automated safety checks, provider safeguards, and human review to detect or investigate prohibited content and abuse. Safety systems are not perfect, and you remain responsible for your Input and Output.
To report potentially unlawful or prohibited content, email support@kling-4.ai with the relevant job or page reference, a description of the issue, and any useful screenshot or timestamp. Mark urgent safety reports as "AUP Report."
Where reasonably necessary, we may reject a request, withhold or remove Output, restrict features, require verification, revoke promotional benefits, suspend or terminate an account, preserve relevant records, or report conduct to the appropriate authorities. Measures will take account of the nature of the issue, applicable law, user safety, and the need to prevent continuing abuse. Paid balances and refunds remain subject to the payment and refund terms below and applicable law.
If you believe we acted in error, you may appeal through the same support address with the relevant account and job information.
The Service may offer promotional credits and credits included with a paid membership. Credit amounts, validity, limits, and membership prices are shown in the Service or before checkout. We do not currently sell standalone credit packs.
We may change future credit prices or grant amounts. A change does not retroactively alter a completed purchase, an existing grant, or the recorded cost of an accepted task.
Paid products currently consist of recurring membership subscriptions. The total price, currency, monthly or annual billing period, included benefits, credit-grant schedule, renewal status, taxes, and material limits are displayed before checkout. Those checkout details form part of these Terms.
Waffo Pancake acts as the payment processor and Merchant of Record for purchases made through its checkout. Waffo Pancake processes payment methods, applicable taxes, payment confirmation, and approved refunds under its own terms and privacy practices.
By starting a recurring monthly or annual membership, you authorize Waffo Pancake to charge the displayed subscription price and applicable taxes at each billing interval until you cancel. Monthly payments grant the corresponding monthly allowance. Each successful annual payment grants the full annual allowance at once; annual plans do not receive additional monthly installments.
Automatic upgrades, downgrades, and replacement subscriptions are not currently offered. A new checkout may be blocked while another checkout or subscription is in progress. Contact support if you need help changing a plan.
Failed or unverified payments do not grant credits or extend paid access. Disputes, reversals, and suspected payment errors are reviewed manually; receiving a refund request does not automatically issue a refund or revoke previously granted credits.
When recurring subscriptions are offered, you may cancel through the account billing controls or customer portal made available with the subscription. You may also contact support@kling-4.ai if those controls are unavailable.
Cancellation prevents future renewals. Unless checkout states otherwise, access already paid for continues until the end of the current billing period. Credits already granted remain available under the current membership policy, but cancellation stops future membership credit installments after the applicable paid period. Cancellation does not by itself create a refund. We will provide any renewal or trial-conversion notices required by applicable law.
AI generation and digital-service benefits may create provider and computing costs shortly after credits or access become available. Accordingly, completed purchases are generally final and non-refundable except where required by law, expressly stated at checkout, or covered by the exceptions below.

Used credits, completed generations, partially used subscription periods, unused time after voluntary cancellation, changes of mind, and promotional credits do not normally qualify for a refund or prorated credit. Approved refunds are returned through the original payment method where possible and may result in the removal of unused credits, access, or future installments associated with the refunded payment.
To request review, email support@kling-4.ai with your account email, Waffo Pancake order reference, and a short explanation. The timing of an approved refund depends on Waffo Pancake, the payment method, and the relevant financial institution. Requests and any related balance adjustments are handled manually. This policy does not limit non-waivable consumer rights.
The Service may rely on third parties for AI generation, safety checks, hosting, storage, authentication, payments, email, analytics, and support. Their services are governed by their own terms and policies. We are not responsible for third-party outages, model changes, or conduct outside our reasonable control.
If API access is made available, you are responsible for keeping API keys confidential and for all requests made with them. You may not publish a key, use the API to bypass product limits, or misrepresent our API as an official Kling or Kuaishou service. We may impose or change reasonable API limits, model availability, safety controls, and credit costs.
The Service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted availability, a particular generation time, output quality, accuracy, resolution, model, or format. AI Output may be incomplete, offensive, inaccurate, or unsuitable for your intended use.
We may update, restrict, suspend, or discontinue features that are experimental, free, unsafe, unlawful, no longer supported by a provider, or commercially impractical. We will honor any non-waivable rights that apply to an existing paid purchase.
To the maximum extent permitted by law, we disclaim all express, implied, and statutory warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and security.
We do not provide legal, intellectual-property, advertising, medical, financial, or other professional advice. You should obtain appropriate review before using Output in a regulated or high-risk context.
To the maximum extent permitted by law, kling-4.ai and its operators, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, business interruption, reputational harm, or substitute services. Our total liability for a claim will not exceed the greater of the amount you paid through the Service during the three months before the event giving rise to the claim or USD 100.
Some jurisdictions do not permit certain warranty exclusions or liability limitations, so some of these provisions may not apply to you.
To the extent permitted by law, you agree to defend, indemnify, and hold harmless kling-4.ai and its operators from claims, losses, liabilities, and reasonable costs arising from your Input, Output, unlawful use of the Service, violation of these Terms, or infringement of another person's rights.
You may stop using the Service at any time. We may restrict, suspend, or terminate access when we reasonably believe that you violated these Terms, failed to pay, created a safety or legal risk, abused free or paid benefits, or threatened the Service or another person.
Provisions concerning ownership, payments, enforcement, disclaimers, liability, indemnity, disputes, and any licenses necessary for lawful retention survive termination.
These Terms are governed by the laws applicable to the operator of kling-4.ai, without regard to conflict-of-law principles, except where mandatory consumer-protection law provides otherwise. Before starting formal proceedings, please contact us and allow a reasonable opportunity to resolve the issue informally.
We may update these Terms to reflect changes in the Service, law, or our providers. We will update the date shown on this page. For material changes, we will provide reasonable advance notice through the Service or by email, normally at least 14 days before the change takes effect unless a shorter period is reasonably necessary for security, legal, or operational reasons.
